CAN Europe and the Global Legal Action Network (GLAN) have taken the European Commission to the European Court of Justice (ECJ). The aim of this legal case is to up the EU’s climate ambition by 2030, by requiring the Commission to revise Member States’ annual emissions allocations under the Effort Sharing Regulation.
The ECJ has acknowledged the gravity of this case by prioritizing this case, reflecting the critical need for judicial oversight in climate action.
The European Commission is set to provide its final written observations by September 2024. A public hearing in Luxembourg is anticipated by September 2025, with a potential ruling by February 2026. The case’s prioritization by the ECJ might expedite this process, highlighting the urgency and the importance of the matter.
